1. Introduction

The EFTA Court handed down its decision in E-9/20, ESA v Norway on 15 July 2021 addressing whether it was possible to impose requirements of EEA citizenship and residence in an EEA state for management and founders of certain companies. Similar requirements exist in Finland, Iceland, and Sweden, and consequently, the judgment may have a wide impact on the Nordic countries.
