The intersection between Articles 15 and 17 of the EU Market Abuse Regulation (MAR) represents a significant collision of rules. While Article 15 prohibits the dissemination of false and misleading information, Article 17 requires the dissemination of accurate and truthful information. Hence, a substantial degree of overlap exists between these two provisions. Given the high volume of cases concerning infringements of Articles 15 and 17, coupled with the notably dissimilar punitive measures imposed for infringements of the two, the state of law in the rule collision between Articles 15 and 17 assumes significant importance. This issue is analysed in the article, which critically examines the prevailing scholarly view, and presents an alternative interpretation.
